1. Introduction
Welcome to Clear The Way Junk & Hauling LLC (“Company,” “we,” “our,” or “us”). These Terms and Conditions govern all services provided by our business, which began operations in late December 2025. By scheduling, authorizing, or receiving any service from Clear The Way Junk & Hauling LLC, you (“Customer,” “you,” or “your”) agree to be bound by these Terms and Conditions.
If you do not agree with any part of these Terms, please do not use our services.
2. Services Provided
Clear The Way Junk & Hauling LLC provides junk removal, hauling, cleanouts, debris removal, and related services for residential and commercial customers.
Service availability may vary based on location, scheduling, weather, safety conditions, and disposal facility access.
3. Estimates & Pricing
- All quotes are based on the information provided by the customer and visual assessment at the time of service.
- Final pricing may change if the volume, weight, labor requirements, or materials differ from the original description.
- Pricing may include labor, transportation, disposal fees, and applicable taxes.
- Written or verbal estimates are valid only for the specified service and timeframe provided.
4. Payment Terms
- Payment is due in full immediately upon completion of services unless otherwise agreed in writing. Depending on the size of the job we might require deposits
- We accept approved payment methods including cash, card, or electronic payment.
- Failure to pay may result in collection action and additional fees as permitted by law.
5. Scheduling & Cancellations
- Appointments are scheduled based on availability.
- Customers must provide reasonable access to the property and materials to be removed.
- Cancellations or rescheduling should be made at least 24 hours in advance when possible.
- We reserve the right to charge a trip fee for missed appointments or last-minute cancellations.
6. Customer Responsibilities
Customers agree to:
- Accurately describe items to be removed
- Ensure safe and legal access to the service area
- Remove or disclose any hazardous, restricted, or prohibited materials
- Secure pets and maintain a safe work environment
- Verify that all items approved for removal are unwanted and legally owned or authorized for disposal
Clear The Way Junk & Hauling LLC is not responsible for the removal of items mistakenly identified by the customer for disposal.
7. Prohibited & Hazardous Materials
We do not accept or remove certain hazardous or restricted materials, including but not limited to:
- Chemicals, solvents, or toxic waste
- Paints, oils, or fuels (unless specifically approved)
- Asbestos or medical waste
- Explosives or flammable materials
- Any materials restricted by local, state, or federal regulations
If prohibited items are discovered, service may be refused or additional handling fees may apply.
8. Property Damage & Liability
We take reasonable care while performing services. However:
- Minor scuffs, scratches, or normal wear that may occur during removal are not considered negligence.
- The Company is not responsible for pre-existing damage, structural weakness, or hidden hazards.
- Customers must report any service-related damage within 24 hours of job completion.
- Liability, if proven, is limited to the cost of the service provided.
9. Donations & Disposal
Items removed may be recycled, donated, or disposed of at our discretion unless otherwise requested in advance. We make reasonable efforts to dispose of materials responsibly but do not guarantee donation or recycling outcomes.
10. Right to Refuse Service
We reserve the right to refuse or stop service if:
- Conditions are unsafe
- Prohibited materials are present
- Payment cannot be secured
- Customer behavior is threatening or inappropriate
- The job differs substantially from what was described
11. Limitation of Liability
To the fullest extent permitted by law, Clear The Way Junk & Hauling LLC shall not be liable for indirect, incidental, special, or consequential damages arising from services provided.
12. Indemnification
Customers agree to indemnify and hold harmless Clear The Way Junk & Hauling LLC from any claims, damages, or losses arising from:
- Misrepresentation of materials
- Unauthorized disposal of property
- Unsafe site conditions
- Violations of applicable laws or regulations
13. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the State in which services are performed.
14. Changes to Terms
We may update these Terms and Conditions at any time. Continued use of our services after changes are posted constitutes acceptance of the revised terms.
